For those in Sandy Creek, there is a new HOA forming as evidenced by a notice we got in the mail. Interesting approach as there are no dues and its only purpose seems to be to prevent condo/marina development in the Sandy Creek area. Am curious what others think but my wife definitely wants us to join. My general philosophy is to avoid NIMBYism but I can see their point about how this proposed development would negatively impact the quality of life in this area of the lake. But I also believe in property rights and if they can get this project funded and permitted they have every right to do so. What to do........

Interesting HOA to fight deveopment. If the zoning allows, it will be built and falls under property rights. If it requires a zoning change to allow more density or height, then that is a perfect reason to fight it.
Progress is hard to fight. Developers don't push for a change unless they have a strong sense it will be approved.
As a non resident, your opinion to the commissioners means very little. No vote, no say.

Interesting. Pretty much matches what the letter stated. I think I know the area where the supposed condo/marina may be constructed. It has been cleared for a year or so and I had heard it was going to be five houses, 3 on the water and 2 upland. When you go by the lots are clearly marked with stakes for 3 lots along the water and others off the water. Maybe they were also planning a common dock so the upland houses have water access. Seems to me far too small for a condo but what do I know.
I wouldn't have as much of a concern with a development like that as it really is single family homes, even with a common dock. As for a marina, I wouldn't use if gas anyway due to the cost of fuel.
I agree that despite paying taxes, being a non voting resident reduces the impact of my opinion. I still find the use of an HOA an interesting approach. Did not know that was possible as I thought HOA's were formed prior to development and included in the deeds which gives them enforcement capability. This HOA would be more along the lines of a lobbying group.

MMno needd to join \. we already have our own that was implemented in 1978 by al. legislation. if you need a copy let me know. 256 825 9973. we have tested ours legally when we filed a lawsuit againist the city and the mayor several years back. won that easily. we have 21 restrictionsin this neighborhood. we are also annexed in dadeville city limits when we established sandy creek estates. the guy starting the HOA does not live here by the way. he has 218 tallahsee st. as address and that HOA would not affect us here.

I know there is an HOA with restrictions for Sandy Creek Estates but the condo development is not in that neighborhood and as I understand it most of the areas around Sandy Creek don't have an HOA or building restrictions. I suppose they rely on the city of Dadeville or Jacksons Gap to hear and respond to the concerns of landowners in the rest of the area.
I'm still trying to figure out how an HOA like this, other than a collective voice for homeowners, can do anything to prevent this development from moving forward. The site has been cleared for quite a while and I am still not clear that it would be a condo/marina as some have stated.

dont know if he (al. power employee) is right about al. power has no zone restrictions on their lake property. zoneing is applied for once developed.

APCO for sure has no authority above elevation 491 unless the own the land. So they don't have a say in what happens unless when they owned the property they deed restricted it or they still own it and are leasing it. Otherwise the zoning is under the control of a city or county and we all know how that goes. Control the zoning commission and you can do whatever you want.
What I do not know is whether that particular parcel is in the city of Dadeville or unincorporated Tallapoosa County. I suspect the latter which means it's the Tallapoosa County Building Department that would have to approve the project.
