2  "of the people on watercraft were injured" just how many were on it at 2:45?

Without any smell...it wreaks of alcohol

We were thinking the same. At a minimum the PWC was being operated illegally. There's a good reason they cannot be legally operated in the dark, and whatever caused that person to be operating one at 2:45 AM was in addition to their being just plain stupid.

They should be snd probably will be in the end.  Lifer is 100% correct.  Host are responsible for guest if it can be proven the guest was intoxicated at the time of departure,

Actually, Alabama does not recognize social host liability except under very limited circumstances, the primary being if a minor is at your home and you provide alcohol to them.  That does not apply to an adult at your home.  Liability under the Dram Shop Act applies to ABC Board Licensees who provide alcohol "contrary to the provisions of law," i.e., after a customer is visibly intoxicated.

Correct.  Like most states.  There are "Open House Party" misdemeanors so cops can break up teenage parties, but those are municipal ordinances.

I think Alabama law has it right. If I was liable for the action any guest in my house, I would never have any guests.  I'm sure Alexander Shunarrah would not agree.

You are not made responsible for your guest, you should be held responsible for your own neglegent action of letting an obviuosly inibreated guest leave in control of ANY motorized trasnport, especially one that you know is illegal and dangerous at night. 

Just my opinion.
