WIX doesn't know what he is posting. Typical WIX. The amendment was on the ballot in March and was defeated. The roads in Willow Point are maintained by Russell. The amendment is to enable the owners to take over and tax themselves to maintain the roads. The state constitution requires that the entire county vote on the change.

-Relating to Tallapoosa County, proposing a local amendment to the Constitution of Alabama of 1901, to authorize the Legislature by local law to provide for the establishment of a road maintenance district in Willow Point Estates and to allow property owners in Willow Point Estates to assess themselves to pay for road maintenance.

Not sure why this requires an amendment but as I understand the issue, Russell Lands would like the County to take over road maintenance in Willow Point. So the question before you is whether you want to pay for their road maintenance.

Apparently, in Alabama there is a law that any time a change effects one part of the county, the whole county has to vote.

Interesting law.  Wonder how it will work out.  I know I would vote no.  I found it odd that the association bylaws didn't have a provision to turn over road maintenance to the homeowner's association at some point like you see with commercial real estate developments.

As a matter of principle I vote no to any new taxes or costs incurred by govt.  Nothing personal against Russell Lands for wanting to offload this cost or the homeowners that want to have others pay for their private road.  Can't blame them for trying.  I just have no inclination to bail them out with tax dollars....not that I have a say in the vote.

I'm surprised too.  The one and only time I lived with an HOA, it was clearing spelled out that when 85% of the houses sold, the HOA would take over the roads.  And our little 11 house sub-division didn't have any problems with that, except as houses turned over in the 90s, some people didn't want to pay their dues - and it was only $300 a year.  That included snow removal, road maintenance and insurance on our common wooded area.

I fail to understand a NO vote.

A NO vote means the county will take over the roads and taxes will pay for upkeep. The roads will then be public. A YES vote will enable Willow Point to take over the roads and pay for the upkeep of their own private roads. Russell will get rid of the maintainance with either a YES or NO vote.

Seems to me that a NO vote is just another low IQ voter.

What makes everyone think that just because RL wants to dump them on the county doesn't mean the county has to take them? They can't force the county to do anything it doesn't want to do and if enough folks are vocal enough it will remain an issue between RL and the homeowners.
