Illegal Appointment
"There’s only three ways a person can become acting attorney general," Napolitano from FOX said. "One, if you are the deputy attorney general — Rod Rosenstein — the president signs an executive order and makes you acting."
"Two is if you are already in the Department of Justice and have a job that requires Senate confirmation and you have received confirmation," Napolitano added. "That is not the case with Matt Whitaker because he’s the chief of staff. That does not require Senate confirmation."
Whitaker's most recent post was chief of staff to Sessions at the Justice Department.
"Three is a recess appointment, which is not relevant here because the Senate is not in recess," Napolitano continued.

If that is true... I'm sure someone from Congress will jog over there and set the man straight.
I am sure he did not make such an appointment without the advice of counsel.
(gotta work on this bold thing. Carlson is right... I too find it annoying. Might have something to do with being 70 years old.)

Is your browser forcing the bold font, or something in the Lakes Online app? Are you using an Apple product, Android, I.E., Firefox, etc? Maybe we could help troubleshoot. Didn't you finally get one post to be non-bold last night?

I figured it out… sort of a work-around.
If I type in Word and cut and paste to populate the LMF field, the words stay in normal font.
Using Windows 10 on Google Chrome.
PS: I now remember the LMF unhappiness with ALL CAPS. To tell you the truth… I have no idea why I did that !

Sounds like a lot of trouble. I don't have Win10, nor do I choose to use Chrome but will check my wife's machine to see what she is using. Pretty sure Win10, not sure about Chrome.
Anyone else out there using the Win10/Chrome combination? If so, maybe you can't help MAJ.

Now if he was "appointed", he would still be subject to confirmation process. People make up crap all the time about what is allowable and what is not. There is a lot more to the Justice Department than just the Mueller investigation and the everyday work needs to still get done. But I also think the President is sending Roberstine a message.

I think the biggest part of the Rosenstein message is that you now have a new boss, and he is not recused, so do not get to comfortable because you are next.
Rosenstein not recusing himself *was* a major problem that just resolved itself. Rosenstein felt he was untouchable due to the Mueller probe - apparently not so untouchable now.

There has been some commentary suggesting that because Whitaker was in a job (chief of staff) that did not require Senate confirmation, he could not become the “acting officer” in a position (AG) that calls for Senate confirmation. Not so. The Vacancies Act enables the president to name an acting officer, who may serve as such for 210 days, as long as the person named has been working at the agency or department for at least 90 days in a fairly high-ranking position. Whitaker qualifies.
