Is it legal (not saying wise) to operate a boat and drink from an open container of alcohol in the state of Alabama? I know it is not legal to operate a boat when drunk, but that is not my question.

I want to say there was a post several years ago from the Marine Police that the simple fact that one might be piloting a boat and consuming an alcoholic beverage is not by itself illegal. I welcome a Marine Police response if I do not remember correctly. That being said, if one is impaired that person should not be operating a boat. Period.

Not against the law to drink and drive boat. Been stopped with an open container. Talked about it with officer and no issues. As stated the obvious....can't be over limit.

there is an open container law for vehicle operation. I think it is a $25 fine. I believe that is probable cause to give a breath test. I.m not sure if the law is different on the water.
