As explained by Justice Thomas his appointment was illegal and I saw Garland trying to explain it to congress and it was a mess.  This one won't likely be heard on appeal until after the election and even if it is by the 11th however they rule it will go to SCOTUS where it will be upheld, because it was the correct ruling.  If Trump wins in November I am guessing the new AG will fire Smith and his merry band of persecutors.

I doubt it will if Trump wins in November because Jack Smith will be out on his partisan a$$ as he should.  But if it does get to SCOTUS it will hinge on Roberts, Barrett & Kavanaugh.
