Nothing has accomplished more toward destruction of the moral fabric and prosperity of our nation than the practice of law. Our Constitution, written in language even we can read 260+ years later, has been morphed into a behemoth quagmire which defies even its current keepers. Nothing has more degraded the law than the current (mal)practice thereof.
Judges will accepted the injection of “precedent” as a substitute for independent judicial wisdom and courage. They permit theatrics and quibbling in the courtroom. Entrapment trumps “the whole truth” in baiting testimony by the uninitiated.
The law is rife with guild language such as “preternate” and “voir dire” and other foreign terms (including latin) which exclude and discourage the common man from the understanding of the legal process.
Lawyers exploit the unjust absence of the concept of “loser pays” to extract large sums of money from individuals and corporations who find that it’s cheaper to settle out of court than to defend themselves in court. (Unique to the U.S.) Greed has inextricably inserted its tentacles into justice. The courtroom has become a bastion of self-aggrandizement. Who pays for all of this. YOU DO! When you buy goods and services.
Let me cite proof that all of this injustice is unnecessary. The Uniform Code of Military Justice (UCMJ) is published in a burgundy colored book the size of a hardbound dictionary. It fits comfortably on the corner of the military commander’s desk. For each crime or infraction is described, in plain language, the tests for guilt of that crime or infraction. Meet the tests = guilty. Does not meet the tests = innocent. There is no “precedent” only the UCMJ and the wisdom and compassion of the commander.
True law needs only tests, wisdom, and compassion. Everything else is greed and avarice. Shakespeare got it right in Henry VI, "the first thing we do is..."
