I have intentionally not posted this video until after the court case was adjudicated. This man Mr James Singleton swam around my dock (off of his Sea Doo) for two hours in September. I asked him if he needed assistance three times and he refused to respond. This is a video of the last twenty minutes before an Elmore County Sheriff deputy arrives. Judge Goggans found him not guilty of any harassment charge today nor the obstruction charge for not obeying an officer as he fled on the Sea Doo. So what you find in this video is not illegal according to Judge Goggans.  I encourage you to watch the link in its entirety and be on the look out for this man should he approach you in this manner.

I viewed the video.  The guy on the video (Singleton) continually, from his PWC, harassed the poster who was on her pier and he refused to leave when asked to and clearly knew he was unwelcomed.  When law enforcement arrived, he refused the deputy's request and took off. Obviously, from the judge's ruling, as long as you are on the water of Lake Martin, you can be as harassing and obnoxious as you want, and there is very little legal remedy.

Betsybug, I commend you on your manner and your attempt to do the right thing. Lake residents are continually advised to video violators of boating laws when possible.  I have no idea if anyone has ever suffered the consequences of such videos.

Videoing violators of common decency and respect we now know gets no results.

According to Judge Goggans this did not constitute a violation of the harassment statute because he wasnt threatening and did not use foul language. I contend that the manner in which he continued to drive his watercraft after I repeatedly asked him to leave me alone was extremely threatening. I should note that he was arrested in 2016 for domestic violence and assualting a police officer. He was taken to jail naked after stripping off his clothes and refusing to get dressed. He was acquitted of those charges as well. Again I do not know this man at all but based on my experiences with him he is extremely dangerous.

This is extremely disturbing.  Hard to believe what he did to you was legal.  I am in total shock that a judge just let him pass....especially since he also had previous charges that indicate he has some sort of psychological and mental imbalance.  He is certainly a threat.  So sorry this happened to you.

IMO, Judge Goggans needs to be relieved of his position on the bench if he doesn't understand why the actions of that man were harassment at best, and threatening at times.

I suggest two solutions.

1. Keep a fishing rod handy, a sturdy one with the heaviest line you can find. Tie a big lure to it, preferably one with a lot of sharp treble hooks. Then use it, without warning. I am sure that the laws favor those who wish to fish from their own property more than those who won't vacate the front of said property and are within reach of a cast.

2. Thsi goes for everyone who reads this post: If you have a Facebook account, copy the link Betsybug provided, and post the video on your timeline; be sure to mention that the man on the PWC is James Singleton of Eclectic. (If you don't mind a legal debate, you can also add tat Judge Goggans feels that actions such as these coming from someone with a documented history of abuse is OK.)

Sorry you had to not only deal with him in person, but also the hassle of pressing the charges that were dismissed.

Obviously the two hrs prior aren't in the video, but I guess the good news is you had time to prop the camera up or use a tripod....my arms would've fallen off.

Thanks for sharing.....it gave me some de-esclation reminders.  If I've called the sheriff and they are on the way and he has been notified, I'm retreating with the camera (and gun).  That was a needless 20 minutes.  You didn't have to put yourself through that, whether it was viewed as harassment or not.  

One of the few ugly sides of lake living....disputes at the shoreline, whether it be wakes or jerks.....either one puts one in a bad mood.

I am in agreement with you about feeling sorry and being concerned about what Betsybug had to experience from such a low-life person. But I disagree with you about descalation. While following your advice would have been the prudent thing to do from a safety standpoint, there would have been "no way" for her to verbally describe what she was subjected to without the video. The extent to which this "creep" provoked her was despicable. I thought any minute that he was going to get off his awsome "wave runner" and come on to the dock. As others have stated, this person has serious psycological/mental problems. The fact that he has been arrested for domestic violence, running around naked,

and assaulting a police officer is evidence that this was not his first transgression. His "brazen" attitude and continuous harrassmeent would seem to indicate that he may have exhibited this "type" of behavior before. His continuous reference to "this is Lake Martin" seemed to offer some insight to his reason for being there. During the 20 minute video he twice called her a "pizzed off woman" and seemed to be "enjoying" the fact that he was able to continue his harrassment until the sherriff arrived.                                                                                                                                                                                                                                                I am no psychologist, but is it possible that his past history may be leading up to an "event" that might not result in a "desirable ending". We all are aware of cases where there have been clues that were not followed up on which, in turn, resulted in an unpleasant ending. In any case, he should not be left with a feeling that his "provocation" against others will be taken lightly and only result in a slap on the wrist.

Oh, definitely keep the video running, just back up & take yourself out of the conversation with him, after calling law enforcement.  I’m glad they responded and showed up.  Hindsight is 20/20, either way it stinks that you had to deal with all of this.

He is a disbarred lawyer who pops up from time to time. Uses this moniker along with others like Seymore Buttsand other juvenile names. He never offers an input of signifance but enjoys playing games like a pre-pubescent teen boy with lots of suxual innuendo. He once pretended to be a Mexican using Pedro as a moniker I think. He kept it up until someone tracked his IP ND found it to be the same as the one we all knew to be him. Then he claimed Pedro was working at his house and using his wifi. After I outed him by name he disappeared for a while, but he pops up every once in a while.

I am not a lawyer, but I play one on the forum... Lol. But even as a lay person I know that every criminal defendant has a right to face their accuser, so naturally she was at the hearing ND of course the judge watched the video. It was recorded for evidence so I can't imagine it wasn't introduced as evedince at the trial/hearing. If it was introduced and then judge didn't watch it then he should be removed from the bench.

As always I could be wrong. I know there are some real lawyers who read the forum and are free to correct me if I am wrong..

And BTW - he is around 70 years old so the juvenile behavior is really creepy.

It is distubing to think tha tbecause he didn't use foul language or issue verbal "threats" that the charges were dismissed.  I would find it pretty threatening to have some guy hanging around my dock and not leaving when I asked him to.  Especialy if I believed he used to own my house.  Because suppose he takes it to the next level, emboldened by the fact he got away with this.  What other mischief will he try to get by with, if not to this person; but to someone else?  I know you can't take legal action based on what you are afraid might happen. The lake is public property, but based on your videos, I think I would persue a restraining order.
