If there are valid, classified documents, and they are kept in the safe, then there isn't a problem. Likley, when he was President, they certified his safe as a "secure container". Has it occured to anyone that he likely still has, at a minimum, his Top Secret clearance? You could try to argue that does he have a "need know"- but if they are papers that relate to things that happened when he was President, I don't think it would stick.
The FBI was likely sent in with aurthority to check his safe and remove boxes. It would be very difficult to make an on the spot determination if a paper was classified or not, if it was not stamped. it's not against the law to rip up a classified document (since most of them are copies) or carry it in your poscket. And I'm not buying the flush. it would be pretty hard to flush papers and require a plumber on standbye.
