Alabama is a one bite rule state. It will be important to speak to your county attorney and find out how they interpret the law. The one bite rule means that the dog owner gets one pass of letting their dog bite you. If you warn them and it attacks again, then they can be held responsible. We learned this after a dog attacked my child when he was walking home from school. I asked them nicely to please contain the dog before something happened because he was getting old and aggressive. They did nothing. I warned them that I would call the animal control if they did not contain it to their property. They refused and went out and added a pit bull puppy to tag along with the older aggressive dog. I called the animal control. They would not pick it up because it had a rabies tag and didn't not care that it was loose even though we have a leash law in our county. It is up to how the county interprets the law. I then contacted the home owners Insurance company and advised them of the problem. The dog now has a nice fenced in yard to stay and play in. I went forward with this because my child was able to defend himself but the dog lives in front of a daily bus stop for elementary school children and are mostly K-3 age. The dog was a full size 80# plus dog.
