Well thanks for the answer...it is not whether or not either party has a veto proof majority but whether they have 40 senators...no matter what the voters say, if the next Pres selects someone you and those with similar ideology declare to be a "radical left wing nut job" then you favor a filibuster to block the nominee if the Repubs can muster those 40 senate votes! Gee, the vacancy may last 9 years with that criteria! I really wish the democrats had evoked the nuclear option and ended the filibuster when it was considered a couple of years ago. This nation is tired of 40 members of either party having the power to stop everything and anything proposed by a president or the lower house!
I fully expect Obama to select a "moderate" by the average American's standards but I doubt you will consider anybody he is willing to nominate anything other than a "radical left wing nut job"! Gee, if Ruth Ginsburg is, for whatever reason, unable to keep her seat we may have a 7 person court for the forseeable future. Heck, as long as the filibuster stands and considering how completely polorized toward the extreme on both sides congress has become, we may not have anybody on the Supreme Court in a few years!!
