I agree with you 100% but I have to correct one thing, appeals don't have juries, just a panel of judges. There is oral argument by lawyers but no new testimony. Oral arguments can be waived by the appellate if they wish.
It is different if you appeal from a city court to district court I believe and it is a lttle different between civil and criminal. I found out this year that Civil cases involving an amount over 50K skips the Court of Appeals and goes directly to the State Supreme Court. I guess they figure at that amount or above that either party that looses is going to go the the SC anyway so it lessens the burden on the courts and the litigants.
