Thanks for your comments. One of the freedoms that we enjoy in this country is the right to post our opinions to our elected representatives and other public instuctions. We can always respectively disagree without fear of trheats and intimidation and grow in knowledge. Opions from others help to increase our knowledge base.

I did visit the web sites for Black Warrior Riverkeepers (quite large and well maintained) and concluded the following.

1. Black Warrior Riverkeepers is an environmental group that is managed in a manner similar to that of:
a. Earth First!
b. Greenpeace
c. The Nature Conservancy
d. Sierra Club

These different environmental groups are very powerful, have many wealthy contributors, and will not hesitate to use the courts to support their agendas. Construction of Nuclear Power Plants, Oil Refineries, etc. have and continue to be delayed because of the permitting process and the legal actions by various environmental groups.

2. Black Warrior Riverkeepers is only 5+ years old and this organization and approximately 153 others Waterkeeper projects are aligned under the Waterkeeper Alliance with Rober F. Kennedy, Jr. as the president. We all know about RFK, Jr. and his ties to Hugo Chavez in Venezula, his hatred of George Bush, his position on global warming, and his opposition to the windmill project because it would hinder views of the ocean.

3. Black Warrior Riverkeepers believe that chicken production in Cullman and Blount counties threatens public health and the Warrior River. They are totally opposed to Confined Animal Feeding Operations (automated chicken houses). They would want to return to the days of raising chickens on a diet of grass and insects in a chicken yard or pasture. The web site states that three times as much animal waste is produced in Northeastern Alabama than could be used to fertilize the entiire state. They have gone to court to prevent construction of these large feeding facilities.

4. What does this organization want to change? Just a few - (a.) Reduce the amount of coal being used in this country to generate electricity - be conservative (b) Global Warming is the most urgent threat facing humanity today (c) Roadless National Forest (d) Reduced development on rivers and streams (e) Strict adherence to existing laws (I agree with this)

You asked for my comments on the Tarry Hyche landfill article in the Black Warrior Riverkeeper web site. The article states that this landfill is permitted to receive construction and demolition waste (inert solid waste) from Winston County and 13 approved manufacturing home builders. If solid waste listed in the permit is delivered to the landfill, then pollution should not be an issue. In fact, the article states that monitoring wells are not required.

So what is the issue? The web site states that the landfill has been inspected 15 times since 1993 and zero fines have been levied against Tarry. Why? Apparently ADEM did not find violations serious enough to levy a fine. Yet, the web site states that non permitted items such as putrescible garbage, industrial wast, toluene, and xylene are being dumped. My experience from many years in the chemical industry is that non permitted releases to a waste treatment plant is a violation of the law and can lead to massive fines and even jail time for site management. My experience with ADEM is that they insist on following the law and issuing correct data.

Water Level management is my top priority item and is acieveable. Moving the level from 510 to 496 in the middle of the summer is unacceptable for a variety of reasons. The cooler water from a deep lake is great for a coal fired steam plant that does not have cooling towers. If cooling towers were installed at the Gorgas Power Plant, fluctations in level would be minimal and similar to that experienced by TVA,
